Power of Attorney for NRI Property in India
If you cannot be in India to buy, sell or register, a Power of Attorney (POA) lets a trusted person — or our desk — act for you. Done properly it is safe and routine; done loosely it invites trouble.
Specific vs general
Prefer a specific POA naming the exact property and acts (sign the deed, present for registration, receive/pay consideration) over a broad general POA. Narrow scope is safer.
Executing it abroad
- Draft the POA in India-appropriate language and execute it in your country.
- Hague-convention countries: notarise, then apostille it.
- Non-Hague countries: attest at the Indian Embassy/Consulate.
Bringing it into effect in India
The POA is then stamped/adjudicated in India (typically within about three months of receipt) and, where the act is a sale, may need to be registered. We handle the stamping and registration locally.
Safeguards against misuse
- Limit scope and validity; name a trustworthy attorney.
- Revoke in writing when done; keep the sale consideration flowing to your own NRO/NRE account.
